FCC overturns SHC ruling on wheat quota policy

ISLAMABAD (Dunya News) – The Federal Constitutional Court has issued an important order in the wheat quota case.

A three-member bench of the Federal Constitutional Court, headed by Justice Aminuddin Khan, heard the Sindh government’s appeal and ruled that policymaking is the responsibility of the executive.

It is worth noting that the Sindh government had filed an appeal in the Supreme Court against the May 31, 2023 decision of the Sindh High Court’s Sukkur Bench.

During the hearing, Additional Advocate General Sindh Sabtain Mahmood appeared before the court and argued that the guidelines issued by the Sindh High Court were not in accordance with the Constitution. Additional Attorney General Munawar Dugal informed the court that the authority to formulate policy lies with the executive.

Justice Ali Baqar Najafi remarked during the proceedings that policies are formulated and announced by the executive. Subsequently, the court set aside the Sindh High Court’s decision and accepted the Sindh government’s appeal.

It may be recalled that a flour mill owner had approached the Sindh High Court to obtain a wheat quota.
