Independence of judiciary not compromised: Justice Baqir Najafi
Pakistan
Says Constitutional Court has so far decided 2,600 cases
LAHORE (Dunya News) - Justice Ali Baqir Najafi of the Federal Constitutional Court has said he does not agree that the independence of the judiciary has been compromised.
Addressing the Asma Jahangir Conference here on Saturday, Justice Ali Baqir Najafi said the Constitutional Court came into existence on November 14, 2025, and within a week, this court has started its work.
He said the Constitutional Court has so far decided 2,600 cases. Every case filed in the Constitutional Court is tried to be decided quickly. The establishment of the Constitutional Court is not a sad thing in the world.
Justice Ali Baqir Najafi said that before the Constitutional Court, the Constitutional Bench was functioning. “There could be ten reasons for the establishment of the court. One reason could be judicial activism. The Supreme Court made decisions in many cases beyond its authority,” he said.
“There was also an allegation that the judiciary had started interfering in policymaking. It was also said that cases would be resolved on other issues instead of being resolved according to the law.
There is a huge debate going on at the moment, one factor could be double standards, another factor is that a popular decision has to be made to get media attention, and another factor is that the state authority has to be challenged,” the justice said.
