IHC to hear petition challenging Judge Nasir Javed's appointment in £190m case

ISLAMABAD (Dunya News) – The Islamabad High Court (IHC) on Friday directed that the petition challenging the appointment of District and Sessions Judge Nasir Javed Rana, who sentenced PTI founder Imran Khan and Bushra Bibi in the £190 million NAB case, be fixed for hearing in the second week of November.

Chief Justice Sardar Sarfraz Dogar of the IHC heard a miscellaneous petition filed by Usama Riaz, seeking an early hearing of the case challenging the judge’s appointment.

During the proceedings, the chief justice asked the petitioner’s counsel, Advocate Riaz Hanif Rahi, about the nature of the case and whether it was related to a 2004 order. The lawyer replied that, according to the Supreme Court’s (SC) October 19, 2004 verdict, Nasir Javed Rana was declared unfit for judicial service, therefore, his appointment as a judge is illegal.

Advocate Rahi added that the matter relates to the case of the late Wahab Al-Khairi, noting that had he been alive, he would have defended the decision himself — hence the petition was filed in his stead.

Chief Justice Dogar remarked that the case would be heard in the second week of November, adding that he was not feeling well today. The court subsequently adjourned the hearing and directed that the case be scheduled for the specified date.
